Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale ("Terms") govern all sales of clothing carried out by Gopo Studio, a sole proprietorship (micro-entreprise) registered under SIRET number 98448061600015, with its registered office at 11 Rue de Savoie, 74910 Seyssel, France, through its website gopostudio.com.

Placing an order on the website constitutes full and unreserved acceptance of these Terms by the customer.


2. Products

The essential characteristics of the products — materials, sizes, colors, etc. — are specified on the website at the time of ordering. Photographs illustrating the products are for indicative purposes only and are not contractually binding.

Products are offered for sale while stocks last.


3. Price

Prices are shown in euros (€). VAT is not applicable, pursuant to Article 293 B of the French General Tax Code.

If payment is made in a currency other than the euro, the amount actually charged may vary depending on the exchange rate and any fees applied by the customer's bank or payment provider. Shipping costs are, in all cases, clearly indicated before the order is finally confirmed.

Gopo Studio reserves the right to change its prices at any time. However, the price applicable is the one in effect on the date the order is placed.


4. Orders and payment

Orders are placed directly on the website. Confirmation of the order by the customer constitutes acceptance of these Terms.

Payment is made securely, using the payment methods offered at the bottom of the website.


5. Delivery and customs duties

For information purposes only and without contractual value, the usual shipping times after dispatch are as follows:

  • France: 2 to 5 business days
  • European Union: 3 to 7 business days
  • International: 5 to 14 business days

The actual delivery time depends on the carrier used and the destination of the parcel.

5.1 International customs duties

For orders shipped outside the European Union, customs duties, import taxes, and any clearance fees are the sole responsibility of the customer, in accordance with the regulations in force in the destination country.

5.2 Refusal to pay customs duties

If the customer refuses to pay these fees and this refusal results in the parcel being returned to Gopo Studio, the following amounts — corresponding strictly to costs actually incurred, with no margin applied by Gopo Studio — will be deducted from the refund:

  • the shipping costs actually incurred for the initial shipment, including any portion covered or offered free of charge by Gopo Studio;
  • the shipping costs for returning the parcel;
  • the administrative fees and penalties charged by the carrier as a result of this return.

This clause applies only in the event of refusal to pay customs duties by the customer. It does not apply to voluntary returns made under the right of withdrawal set out in Article 6.

6. Right of withdrawal (14 days)

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify any reason or pay any penalty.

Before making any return, the customer is invited to contact Gopo Studio at contact@gopostudio.com in order to agree together on the most suitable solution: exchange for another product or another size, or refund. Return shipping costs remain the customer's responsibility.

The refund is made within 14 days of receipt of the returned products, or proof of their dispatch, using the same payment method as that used for the purchase. This refund may be subject to the deductions provided for in Article 5.2 above, in the event of a prior refusal to pay customs duties.


7. Legal warranties

Every product purchased on the website automatically benefits from the following legal warranties.

7.1 Legal warranty of conformity

(Articles L217-3 to L217-20 of the French Consumer Code)

The customer has a period of two years from delivery of the goods to take action under this warranty. During the first 24 months following delivery, any lack of conformity is presumed to have existed at the time of delivery.

The customer may choose between repair and replacement of the goods. If this is impossible or if the cost is disproportionate, the customer may obtain a price reduction or termination of the contract.

7.2 Warranty against hidden defects

(Articles 1641 to 1649 of the French Civil Code)

The customer may invoke the warranty against hidden defects and choose between rescission of the sale or a price reduction.

8. Intellectual property

All content on the website — text, images, logos, graphic designs — is the exclusive property of Gopo Studio. Any reproduction, in whole or in part, is strictly prohibited without prior written authorization.


9. Personal data

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act ("loi Informatique et Libertés"), Gopo Studio collects and processes its customers' personal data under the following conditions:

  • Purposes: order processing, delivery management, customer relations, and marketing communications, subject to the customer's consent.
  • Legal basis: performance of the sales contract; consent or legitimate interest for marketing purposes.
  • Recipients: only the service providers necessary for fulfilling the order, such as the carrier or payment provider.
  • Retention period: for as long as necessary to manage the customer relationship and comply with applicable legal obligations.
  • Customer rights: right of access, rectification, erasure, restriction, objection, and portability, exercisable by contacting contact@gopostudio.com.
  • Complaints: the customer may lodge a complaint with the CNIL (French Data Protection Authority) — www.cnil.fr.

10. Textile sorting, recycling, and end of life

In accordance with the French law on combating waste and promoting the circular economy ("loi AGEC"), textile products sold by Gopo Studio are subject to sorting requirements.

Customers are encouraged to drop off used clothing at a dedicated collection point — textile container or charity/reuse center — rather than disposing of it with household waste. For more information, visit refashion.fr.


11. Force majeure

Gopo Studio shall not be held liable for any delay or failure to perform its obligations resulting from an event of force majeure, within the meaning of Article 1218 of the French Civil Code — such as a natural disaster, a strike, or a breakdown of transport or communication systems.


12. Severability

If one or more provisions of these Terms are held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


13. Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation, performance, or the validity of the sale falls within the jurisdiction of the French courts.
